The petition challenged violations of the laws governing protected and regulated zones, specifically the restrictions established under the Ancient Monuments and Archaeological Sites and Remains Act (AMASR Act) and applicable Municipal and Development Control regulations.
Such zones exist to preserve the character, setting, and structural integrity of India's protected heritage monuments, and any construction within them requires prior clearance from the National Monuments Authority (NMA).
Construction in protected and regulated zones around heritage monuments is strictly governed under heritage laws. The AMASR Act creates absolute restrictions on construction activity within prohibited and regulated zones, and any violation is actionable by way of writ petition before the High Court. Courts will not hesitate to restrain such construction to preserve India's cultural and architectural heritage.
